four40 is committed to protecting and respecting your privacy



1. ACCEPTANCE OF TERMS


The following Terms of Service ("Terms") are between you and four40 SAS ("four40") and constitute a legal agreement that governs your use of four40's product, software, services and website (collectively referred to as the "Service"). You must agree to these Terms before you can use the Service. You can agree to these Terms by actually using the Service. If you do not agree to any of the following terms, please do not use the Service.



2. DESCRIPTION OF SERVICE


The Service includes a variety of features, including but not limited to communication tools, schedule management, and notifications summarization. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, shall be subject to these Terms.



3. YOUR REGISTRATION OBLIGATIONS


To obtain and use the Service, you will be required to register with four40 by completing a registration form and designating a user ID and password. When registering with four40 you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.



4. USER ACCOUNT, PASSWORD, AND SECURITY


You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for any and all activities that occur under your password or account.



5. USER CONDUCT/ACCEPTABLE USE POLICY


You agree to not use the Service to:

  • interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

  • intentionally or unintentionally violate any applicable local, state, national or international law;

  • provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the French government as a foreign terrorist organization.



6. PRIVACY AND PERSONAL INFORMATION


For information about four40's data protection practices, please read four40's Privacy Policy, which is hereby incorporated into these Terms. This policy explains how four40 treats your personal information when you use the Service.



7. MODIFICATIONS TO SERVICE


four40 reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that four40 shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.



8. TERMINATION


You agree that four40 may, under certain serious circumstances and without prior notice, immediately terminate your four40 account and access to the Service.



9. DISCLAIMER OF WARRANTIES


YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.



10. LIMITATION OF LIABILITY


YOU EXPRESSLY UNDERSTAND AND AGREE THAT four40 SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF [Your Company's Name] HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE.



11. EXCLUSIONS AND LIMITATIONS


Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of sections 9 and 10 may not apply to you.



12. GENERAL INFORMATION


These Terms constitute the entire agreement between you and four40 and govern your use of the Service, superseding any prior agreements between you and four40 on this subject. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, or third-party software.

These Terms and the relationship between you and four40 shall be governed by the laws of the French Republic without regard to its conflict of law provisions.
